I. Definitions:
1. “Platform”, “Site” refers to MOG website and any associated services, tools, or applications.

3. “Team” refers to members of MOG (and DLILAH LIFE (OPC) PRIVATE LIMITED) who operate our platform on a day-to-day basis or are specifically contracted by us for a particular period of time.
4. “Services” encompasses all features, functionalities, events, and resources provided through the Platform, intended to support and promote holistic wellbeing.
5. “Content” (“Information”) includes, but is not limited to, text, images, multimedia, comments, and any other information or data uploaded, shared with, or published on the Platform. This may also include Content shared with us on third-party mediums such as Social Media platforms, Email, etc.
6. “Therapist” (“Professional”) is a certified mental health professional registered on the Platform to offer counseling or therapy services.
7. “Childbirth Educator” (“Professional”) is a certified, trained and experienced professional who provides expectant parents and their families with evidence-based information, education, and support related to pregnancy, childbirth, and the postpartum period.
8. “Doula” (“Professional”) is a trained professional who provides continuous physical, emotional, and informational support to an expecting individual before, during, and after childbirth. The role of the Doula is non-medical in nature and is intended to complement medical care by offering guidance, comfort, and advocacy for the birthing person and their family.
9. “Lactation and Breastfeeding Support” (“Professional”) A Lactation and Breastfeeding Support Professional is a certified and trained individual who provides education, support, and guidance to parents regarding breastfeeding and lactation.
10. “Infant Massage Training” (“Professional”) An Infant Massage Training Professional is a trained individual who instructs parents and caregivers on the techniques and benefits of infant massage.
8. “Helpline” denotes telephonic or online services offering crisis intervention or mental health support.
9. “Community” refers to the collective group of all users and participants on the Platform, including individuals seeking mental health resources, therapists, support group coordinators, helpline operators, event organizers, and Resource Providers. The Community is bound by a shared interest in holistic health awareness, support, and advocacy, engaging in collaborative and supportive interactions through the Platform’s features and services.
10. “Support Providers”, “Service Providers” refers to the Community of individuals, groups, organizations, therapists, professionals and other Service Providers listed with us for the purposes of helping Users care for their holistic health. These are third parties, not employees, contractors or representatives of MOG.
11. “Event” covers any childbirth education, workshop, seminar, or gathering organized either by the Platform, or Community, aimed at promoting holistic health awareness or education. “Community Event” specifically implies an event organized by the Community that isn’t owned or operated by MOG.
12. “Resources” encompasses the educational and therapeutic materials available for access or download. These could include articles, podcasts, videos, self-help tools, and other informational content designed to improve holistic health and wellbeing. This can also include Products.
13. “Products” refers to any physical or digital goods offered through the Platform that are intended to support, enhance, or facilitate users’ health and wellbeing. This includes, but is not limited to, books, therapeutic tools, educational materials, apps, and merchandise. Products may be provided by MOG or by third-party the respective Service Providers or Resource Providers through the Platform.
14. “Resource Provider” is any entity or individual that provides educational, informational, or therapeutic resources on the Platform.
15. “Listing” refers to the act of displaying or making available information, resources, services, or products on the Platform. This could include, but is not limited to, the display of Child Birth Education Professional, Doula Support Professional, Emotional Support and Wellbeing Professional “Mental Health Therapists”, Lactation and breastfeeding Counselling Professional, Post Natal and Postpartum mental health services professional, Infant massage Training Professional, New Born Care Professional, helplines, events, resources, and products. A Listing may be created by a Child Birth Education Professional, Doula Support Professional, Emotional Support and Wellbeing Professional “Mental Health Therapists”, Lactation and breastfeeding Counselling Professional, Post Natal and Postpartum mental health services professional, Infant massage Training Professional, New Born Care Professional, a Service Provider, or Resource Provider, Or Listing Operator and is intended to provide valuable information or services to the Community. A Listing may also be made by MOG if it’s a resource or product it offers by itself.
16. “Listing Operator” refers to the entity or individual who the Listing Content refers to. They’re responsible for creating, and maintaining the accuracy of Listings on the Platform. This could be a specific Child Birth Education Professional, Doula Support Professional, Emotional Support and Wellbeing Professional “Mental Health Therapists”, Lactation and breastfeeding Counselling Professional, Post Natal and Postpartum mental health services professional, Infant massage Training Professional, New Born Care Professional, a Service Provider, or anyone else the Listing refers to. Listing Operators communicate their details to MOG, to ensure they can add, edit, or remove information, resources, services, or products from their Listings, ensuring that the Community has access to the most accurate and up-to-date information.
17. “Testimonials” refers to content that is created and provided by individuals or entities other than the primary Team of the Platform. These posts may offer unique perspectives, insights, or expertise on topics related to Child Birth Education, Doula Support, Emotional Support and Wellbeing, Lactation and breastfeeding, Post Natal and Postpartum mental health services, Infant massage, New Born Care. Testimonials are typically published on the Platform’s blog or resources section or Testimonials section, and are subject to approval and editing by the Platform’s team to ensure they align with the Platform’s standards and guidelines.
II. Disclaimers:
1. Information on MOG is provided for informational and educational purposes only. It should not be considered as medical advice, whether toward diagnosis or treatment of a mental or physical health problem, or for prescribing medication.

Child Birth Education Professionals, Doula Support Professionals, Emotional Support and Wellbeing Professionals “Mental Health Therapists”, Lactation and breastfeeding Counselling Professionals, Post Natal and Postpartum mental health services professionals, Infant massage Training Professionals, New Born Care Professionals have no medical role and / or decision making, cannot guarantee any birth outcome, cannot replace a doctor or a family member, cannot give any medical advice, cannot speak on your behalf to the doctor.
III. Service Providers Listed On Our Platform:
MOG is not in the business of providing counselling, helplines, support groups and other services listed on the platform. MOG does not own, operate or control the Child Birth Education Professional, Doula Support Professional, Emotional Support and Wellbeing Professional “Mental Health Therapists”, Lactation and breastfeeding Counselling Professional, Post Natal and Postpartum mental health services professional, Infant massage Training Professional, New Born Care Professional, helpline numbers, Community Events, support groups, and other Service Providers listed on the website. Contact details to Service Providers and otherwise are listed for reference or informational purposes only.
MOG does not make any recommendations or guarantees regarding the quality of response, medical or non-medical advice Users might receive from the respective Service Providers. Further, the listing of our resources, tips, and Content on our platform are meant to give an overall understanding of topic discussed, and should not be interpreted as advice that is either professional, medical or otherwise.
MOG is not designed to offer support in medical or psychological emergencies. If you are in such a situation, please contact a trusted emergency service, reach out to a trusted friend or family member, or a visit a trusted nearby hospital. The same should not be interpreted as a service from The Platform, unless explicitly mentioned otherwise. When you engage with such Service Providers, you’re not engaging with MOG, but with the individual Service Provider directly on their own terms.
MOG does not endorse the Service Providers and makes no representations, warranties or guarantees as to, and assumes no responsibility for, the services provided by these entities and individuals.
MOG disclaims all liability for damages of any kind arising from users reaching out to the Service Providers listed on our platform, or otherwise.
Service Providers and Resources listed on this Platform can (at their sole discretion) accept, decline and/or re-schedule your requests.
You understand that MOG cannot be held responsible for the actions, negligent or otherwise, of the Service Providers, Resources and Products listed on the Platform.
IV. Privacy
MOG is committed to protecting your privacy in your interactions with the Platform. Check out our Privacy Policy to see what personal information we may collect on/away from the Platform and how we use it. Do keep in mind that this is the privacy policy of MOG and it may not be the privacy policy of the Service Providers, Listing Operators, Resource Providers, Products or Resources you interact with on/away from the Platform. You understand that MOG does not guarantee that anything on the Site will be free of infection, viruses or other items that might damage or interfere with your computer, data or personal information. Photo/Video Release
By participating in our classes, you hereby grant MOG the right to capture photographs and videos of you and your family during the sessions. You also grant MOG permission to use these images and videos on our website, social media platforms, and in any other marketing or promotional materials, including but not limited to print, digital, and online formats.
If you prefer that you and/or your family’s images not be used for these purposes, you may opt out by notifying us via email at info@mogbirth.org before the start of the class.
V. Intellectual Property – Copyright, Trademark and Disclaimer Notices
The contents of the Site, such as text, design, graphics, logos, trade dress, audio clips, video, games, photographs, software, interfaces or code (the “Content”) and the selection and arrangements of the Content is the property of MOG and the respected partners associated with that activity, or other respective owners that have granted MOG the right and/or license to use such marks. Such trademarks and content may not be used except as provided in these Terms or in the text of the Site.
You may not print and download the Content for personal, non-commercial or commercial use. No portion of the Content may be reprinted, republished, modified, or distributed in any form without the express written permission of MOG. You may not reproduce, reverse engineer, decompile, modify, transmit, sell, distribute, license or create derivative works of the Content.
VI. Misuse of Platform
Terms Of Service Users are strictly prohibited from using this platform for any purpose other than finding Child Birth Education, Doula Support, Emotional Support and Wellbeing “Mental Health Therapists”, Lactation and breastfeeding Counselling, Post Natal and Postpartum mental health services, Infant massage Training, New Born Care, for themselves. Any use of this platform for purposes including, but not limited to, reaching out to a Service Provider or resource on the platform for collaboration purposes (commercial or otherwise), duplicating or scraping the data on our platform for personal or commercial purposes, conducting research, seeking professional contacts for media or journalistic purposes, or copying content from our platform in any way, is considered a violation of these terms of service.
Such misuse will result in strict action against the user, as deemed appropriate by the MOG team, including but not limited to permanent suspension from using our platform. MOG reserves the right to take any legal action necessary to protect its intellectual property and the integrity of the platform. VII. No Warranties
You use the Site and the internet at your own risk. The Site, its Content, and all services provided through it are offered "as is" and "as available" without any warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, warranties of title, non-infringement, merchantability, and fitness for a particular purpose, relating to the Site, its Content, listed Service Providers, and any services offered through the Site or the internet.
We expressly disclaim any and all implied warranties. MOG cannot be held responsible for the misuse of (not limited to) the content on the Platform.

Our Terms are governed by the laws of the Republic of India, and the courts in Mumbai, India, will have exclusive jurisdiction over any disputes arising out of the use of this Platform.

(d) Your breach of any confidentiality obligations; and
(e) If you access MOG through a third-party platform, any data breach occurring due to the acts or omissions of that third-party platform.
2. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of, Maharashtra, India, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Mumbai, Maharashtra, India.
You hereby consent to the jurisdiction of such courts and waive any objection to the venue or jurisdiction in such courts.
X. Acceptable and Lawful Use of Site
You agree to comply with all applicable laws and regulations when using the Site. Any information you provide to MOG in connection with the Platform must be accurate and truthful. You understand that providing inaccurate information may impact MOG's ability to provide services and could result in the loss of services from its internet service providers, support providers, or other suppliers. Contact Information: Upon exceptional request, and to the best of its ability as an aggregator platform, MOG may provide contact information for third-party Service Providers or Resource Providers. However, all payment-related matters must be resolved directly between the user and MOG.

XIX. Refunds:
